Collecting personal information

Your personal information is collected for the purpose of providing you with our carsharing service. Flexicar will use your personal information only to the extent set out in this Policy. 

Use of your personal information

Flexicar uses any personal information you supply to us to provide you with carsharing services, and for processes that are directly related to the provision of these services to you.  

Flexicar may communicate with you regarding your reservation or rental transaction, your membership/status in Flexicar membership program, or regarding changes to the terms or features of our membership programs to which you belong. 

Flexicar may use your personal data to provide you with marketing information, special offers, and promotions via various means including e-mail, in accordance with applicable law. You can unsubscribe from receiving such messages at any time by contacting Flexicar at the details below under "Contact Us" or the ‘Unsubscribe’ link in each e-mail message.

Flexicar may share your personal information with third party affiliates who assist (directly or indirectly) with the provision of the carsharing services to you, including to service providers, related corporate entities, business partners, discount sponsors and/or licensees (“Affiliates”).  These Affiliates may be based outside of Australia and New Zealand.

For customers with a bank account or locally issued credit card in Australia and/or New Zealand, we may also share your personal data with your banking institution, to assist in resolving queries or disputes instigated with or by your bank around our charges. This is on the basis of our legitimate interests, or your instruction.    

If you request information from us, any information you supply will only be used to satisfy your request.

If you apply for Flexicar membership, some of the information you supply may be shared with Flexicar’s insurance company and payments facility provider. Flexicar does not share your information beyond what is necessary to approve your application.

Flexicar may also use your personal information to comply with legal requirements or to assist in law enforcement (such as a request from the police), or to protect against fraud. 

Flexicar will not use or transfer your personal data other than as set out in this Policy.

Website statistics

Flexicar’s web server uses “cookies” and other electronic tools to collect statistical information that details the traffic on our site. When you visit Flexicar’s web site, Flexicar may obtain information from your personal computer that provides your internet address, your domain name (if applicable), the previous site you have visited and when you visited the website. Flexicar may analyse this information and use aggregate statistics to improve the content and navigation on our site. However, this information is not linked to any information you may provide and cannot be used to identify you. 

You may be able to set your browser to disable cookies, but if you do so, some parts of the Flexicar website may not function as intended.

Access

If you require access to the information Flexicar may have concerning you, you may request this, and it will be provided subject to any exemptions allowed under the privacy laws of Australia and/or New Zealand (as applicable to you).  If Flexicar refuses to allow access to your personal information, you will be informed of this and given details of what exemptions under the privacy laws prevent its acquisition.

Accuracy

All reasonable steps are taken to ensure that the personal information Flexicar holds is accurate, complete and up-to-date. If any information Flexicar has is inaccurate, please contact Flexicar immediately and Flexicar will take all reasonable steps to correct it.

Security

All information is kept in a secure environment. Electronic security includes the use of fire walls and password access to designated personnel. This is to ensure personal information is not accessed by unauthorised personnel, lost or misused.

Payment security is managed through Cybersource for mutual security.  Encryption protection is managed with an SSL (Secure Socket Layer) certificate, industry standard 128bit encryption software.

To help Flexicar protect your privacy, you should maintain the secrecy of any logon IDs and passwords, Member numbers, or other identifiers or credentials you may have set up or were provided with in connection with your participation in or use of our products, services, or websites.

There is no completely secure method of transmitting or storing data. Although their physical characteristics are different, postal mail, telephone calls, text messages, faxes and transmissions over the internet or wireless networks all present possibilities of loss, misrouting, interception and misuse of the data that is transmitted. If you have reason to believe that your account with Flexicar is no longer secure, please immediately contact us.

Disputes

Any disputes relating to an individual’s personal data as processed or stored in Australia and/ or New Zealand shall be resolved in accordance with the laws of that country.
